WHAT THE GOLF? TERMS OF SERVICE

Introduction:

We are Triband ApS (“Triband”) – the makers of WHAT THE GOLF? We are a comedy games studio based in Copenhagen, at Gothersgade 160, 1123 Copenhagen K, Denmark, registered at the Danish Business Authority with company registration number: 37776998

These terms of service (“Terms”) is a piece of information we would like for you to read, as the Terms set out the relationship between you and Triband ApS. It is about our game, WHAT THE GOLF? (“Game”) and the way you should use it. The instructions and manuals that we provide to the Game are considered as part of the Game for the purposes of these Terms. When you play our Game, the Terms apply along with terms applicable to the platforms you play the Game from. 

By installing, using, or accessing our Game you accept our Terms. 

We may decide to change some of these Terms when we think it is necessary, and we will post the changed Terms on our website and on the specific platform pages.

Right to use our services:

We grant you a license to download, install, stream, and play the Game (“License”). The License is non-exclusive, non-transferrable and limited to your own personal, non-commercial entertainment purposes. 

This means that you do not own the Game, but you are allowed to use it accordance with these Terms. 

Limited license to use the game:

The following limitations apply to the License:

  • Any kind of copying, transfer or distribution of the Game requires our permission

  • Circumvention of copyright protection is prohibited and considered a copyright infringement

  • Reverse engineering and decompiling are not allowed

  • You may not use the Game for illegal or harmful purposes

  • You may not commercialise the Game in a way not approved explicitly by us

  • You may not use cheats, automation software (bots), hacks or any other unauthorized third-party software, tools or content designed to modify the Game experience

  • You may not modify, translate, or create derivative works based on or utilizing any parts of the Game

Limited license to broadcast gameplay:

At Triband, we focus on having an active and excited community of users of our Game. To incentivize this, we hereby grant you a limited, revocable, royalty-free license to broadcast, i.e., upload and livestream your own unique experiences within the Game, including the sounds and music in the Game (“Content”).

The limited broadcast license is subject to you complying with the following conditions:

  • You may only create Content and distribute such Content on your own website, or other websites, where anyone can view the Content for free. Examples of acceptable forms are, without limitation: tutorials, reviews, reactions, instructions and other videos which include your commentary;

  • The Content must comply with these Terms, our Privacy Policy and our Community Guidelines;

  • You may not use the Content for commercial purposes, i.e., to make money or for other forms of financial gains, except that you are allowed to monetize your Content through partner-programs and/or advertising, provided that the Content is available for free;

  • You assume all liability for ensuring that your Content, and any monetization of the Content, fully complies with all applicable laws etc.;

  • We may at any time revoke your license to broadcast the Content for any reason and without further notice. 

Intellectual Property:

All intellectual property rights relating to our Game are either exclusively owned by us or have been licensed to us. 

This includes for example copyright to source code, characters, setting, music, text, dialogue and artwork, design rights to user interfaces, trademarks, patents, know-how, trade secrets, rights to names, titles and themes, etc. 

As these rights are very important to us, it is important that you understand that while our Game is being licensed to you, no title or ownership in our Game is being transferred or assigned and that you are not allowed to use any of our rights without our permission. 

While we are the creator of the Game we have additionally been honoured by some of our colleagues in the game industry that allow us to parody elements from their games to include in our Game. 

In this connection, we want to emphasize on the fact that any pieces of work protected by intellectual property rights etc. (“Properties”), that are not our own and that is used in the Game, we have received permission from the rightful owners to parody and use in the Game. All rights are reserved by the rightsholders, whereas they have not endorsed the Game as such. 

Therefore, we kindly ask you to treat all Properties pertaining to the Game with the upmost respect and in full compliance with our Terms and Community Guidelines. 

You are allowed to use Properties owned by or licensed to us ONLY in accordance with the Terms and Community Guidelines. 

In short, please do not mess with our Properties, or any other Properties, which have been licensed to us. If you damage any of the Properties in the Game – including without limitation the source code, name, brand, trademarks, content – we may have to ask you to repay any losses incurred as a result of this. 

Your obligations:

You are first and foremost expected to have fun while playing our Game. 

On a more serious note; you may not:

  • Attempt to gain unauthorised access to our Game;

  • Attempt to disrupt or burden the normal operation of our Game, or any of our infrastructure or any other business activities;

  • Post another person’s personal information or data through our game without that person’s consent;

  • Use our Game to distribute any information, content or materials that is in breach of our Community Guidelines.

Privacy Policy:

You should also make yourself familiar with our Privacy Policy which you can find through the platform where you play the game.

Miscellaneous: 

Assignment - We may wish to transfer some or all our rights and responsibilities to someone else without obtaining your consent and will do so only if you do not suffer from severe disadvantages due to such transfer. 

Waivers – If we fail to exercise or enforce any of our rights under these Terms we do not mean to waive our right to enforce such right. Please wave to agree.

Governing Law - These Terms are governed exclusively by Danish law, excluding its choice of law provisions. All legal actions shall be bought in the Copenhagen City Court and settled by jousting.

Force Majeure - Notwithstanding anything else contained in these Terms, we are not liable for any delay in or failure to comply with these Terms if the delay or failure is caused by circumstances beyond our reasonable control, including without limitation, pandemic, fire, flood, sudden ice age, strikes, lock outs, stoppage of work, trade disputes or any act of war or terrorism.
